We represent employers in New York. Our firm is comprised of litigators who typically defend employers in labor and employment matters against employees, unions, and government agencies on an hourly retainer basis. We also counsel, advise, and represent employers who do not have any litigation matters in an effort to prevent litigation from happening in the first place. We can do so on a pay per service fee or annual retainer basis which consists of a flat yearly fee (typically divided in twelve equal monthly installment payments) and provide the following services with unlimited hours:

  • Day-to-day legal consulting on labor/employment law (You can call us any time and as much as you need to at no extra charge). Think of us as your general labor counsel like reviewing contracts etc.
  • Providing updates on the law and consulting to insure compliance. (This is very valuable as the law is and will be constantly changing)
  • Harassment Training (recently required by New York State on an annual basis to protect Company from liability under Federal laws)
  • Drafting and/or revising Company handbook
  • Drafting and instituting non-competition, non-solicitation, and confidentiality agreements
  • Drafting and instituting a Mandatory Policy of Arbitration of all Employment Related Disputes (deters public filings, prevents class/collective actions and limits to one employee per dispute, more favorable forum with arbitrator rather than with Court which is employee friendly)
  • Statute of Limitations reduction policy (limiting the time an employee can sue for certain New York State law claims from six years to as little as six months, greatly reducing exposure), as well as other important policies
  • Wage/hour review (specifically looking at how you pay each employee and advising you of its propriety and how to protect yourself) and drafting of all policies and records to insure compliance with State and Federal laws
  • Drafting New Hire letters and consulting on hire, fire and disciplinary decisions.
  • Drafting Severance Agreements when employees leave to protect you from claims they can make as late as six years after they leave.
  • Drafting employee warning, suspension, and termination letters, otherwise serving as an extended Human Resources office for your business.
  • Conducting annual employment law compliance audits of Federal, State, and City laws
  • NYC Sick Leave Law, and other discrimination, harassment, disability, and employment law etc. compliance
  • Providing all Federal, State, and City Posters and insuring all posting requirements
  • Reviewing insurance requirements (including employment practices liability insurance and wage/hour defense policies)
  • Reduced flat rate hourly rates for any litigation at the agency or court level.
  • Finally, to the extent that I can competently do so, I can help you with other legal matters that may arise from time to time, as well.

This kind of arrangement permits our clients to freely reach out to us with any questions and not be concerned about receiving a high bill for work performed on an hourly basis. Further, to the extent that a client does have any litigation, our rates are competitive on a stand-alone basis with any reputable firm in New York and are further discounted for annual retainer clients.
